1. Acceptance of Terms

By downloading, installing, or using EquiPulse ("the App"), you agree to be bound by this End User License Agreement ("Agreement"). If you do not agree to these terms, do not use the App.

This Agreement is between you and 6tSevn BV, not with Apple Inc. 6tSevn BV is solely responsible for the App and its content.

2. Description of the App

EquiPulse is a horse management and care companion application for iOS and watchOS. It allows horse owners and equestrians to:

• Manage horse profiles (breed, age, weight, health history)
• Record and track health metrics (temperature, weight, heart rate, hoof condition, dental records)
• Log vaccinations and schedule veterinary appointments
• Maintain a personal journal with photos
• Track training sessions and lessons
• Manage feeding schedules
• Record and analyse expenses
• Organise contacts (veterinarians, farriers, and other professionals)
• Receive reminders for upcoming health events
• View a summary of their horses and agenda on Apple Watch

3. License Grant

6tSevn BV grants you a limited, non-exclusive, non-transferable, revocable licence to use the App on Apple devices that you own or control, subject to the terms of this Agreement and the App Store Terms of Service.

4. User Data and Accounts

The App does not require you to create an account. All data you enter — including horse records, health data, journal entries, training logs, expenses, and contacts — is stored locally on your device using Apple's SwiftData framework.

6tSevn BV does not collect, access, or process any personal data you enter into the App. See the EquiPulse Privacy Policy for full details.

5. Subscription Plans

EquiPulse is available in a free tier and a Premium subscription.

Free Tier — included at no cost:

• 1 horse profile
• Up to 10 agenda events
• Up to 5 journal entries
• Feed schedules
• Color themes
• Notifications and reminders
• Search

EquiPulse Premium — auto-renewable subscription: Unlocks all features including:

• Unlimited horse profiles
• Unlimited agenda events
• Unlimited journal entries
• Full health tracking and charts (temperature, weight, heart rate, hoof, dental, and more)
• Expense management and PDF reports
• Training and lesson logs
• Unlimited contacts (veterinarians, farriers, and more)
• iCloud Sync across all your Apple devices
• PDF export for horse reports, journals, and feeding schedules

Subscription options: Monthly plan (billed monthly) or Annual plan (billed once per year, best value). A 7-day free trial is available for new subscribers. Pricing is displayed in the App in your local currency.

6. Billing and Renewal

• Payment is charged to your Apple ID account upon confirmation of purchase or at the end of the free trial period.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscription at any time in your Apple ID account settings.
• Refunds are handled by Apple in accordance with their refund policies. 6tSevn BV does not process refunds directly.

7. Permitted Use

You agree to use the App only for lawful purposes and in accordance with this Agreement. You agree not to:

• Copy, modify, or distribute the App or any part of it
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or sublicense the App
• Attempt to gain unauthorised access to any part of the App or its infrastructure
• Use the App in any way that could damage, disable, or impair the App or its functionality
• Use the App's name, logo, or trademarks without prior written permission from 6tSevn BV

8. Intellectual Property

The App, including its design, code, graphics, and content, is owned by 6tSevn BV and protected by copyright, trademark, and other intellectual property laws. This Agreement does not grant you any rights to 6tSevn's trademarks or other intellectual property.

9. Privacy

Your use of the App is governed by the EquiPulse Privacy Policy. All data you enter is stored locally on your device. 6tSevn BV does not collect, process, or have access to your horse records, health data, journal entries, or any other information you enter into the App.

If you enable iCloud Sync (Premium feature), your data is synchronised through your personal Apple iCloud account using Apple's CloudKit. 6tSevn BV has no access to this data.

10. Disclaimers and Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

EquiPulse is not a substitute for professional veterinary advice. Health records and reminders in the App are management tools only. Always consult a qualified veterinarian for medical decisions regarding your horses.

To the maximum extent permitted by applicable law, 6tSevn BV shall not be liable for:

• Loss of data due to device failure, software errors, or accidental deletion
• Any indirect, incidental, special, or consequential damages
• Damages arising from your reliance on App content for veterinary or health decisions
• Interruption or unavailability of the App or iCloud services

11. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete it from your devices.

6tSevn BV reserves the right to discontinue the App or any of its features at any time.

12. Updates and Changes

6tSevn BV may update the App and this Agreement from time to time. Updates may change or remove features. Continued use of the App after an update constitutes acceptance of the revised Agreement. Significant changes will be communicated through the App Store release notes.

13. Governing Law

This Agreement is governed by the laws of the Netherlands. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

14. Apple — Third-Party Beneficiary

You acknowledge that Apple is a third-party beneficiary of this Agreement and has the right to enforce its terms against you. Apple has no obligation to provide maintenance or support for the App.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.

Apple is not responsible for addressing any claims by you or any third party relating to the App, including: product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
